exif.pl — Terms of Use

These Terms of Use govern access to and use of exif.pl at https://exif.pl/, including its website, browser-based EXIF metadata viewer, features, documentation, and related services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

The Service provides browser-based tools for reading, displaying, filtering, previewing, and exporting metadata from photographs and other supported files. Metadata parsing is designed to occur locally on the user's device. The application does not intentionally transmit selected photo contents to exif.pl servers. Loading the website may request fonts from a third-party font provider, and choosing to display GPS map data may request content from a third-party map provider.

The Service may be modified, updated, suspended, restricted, or discontinued at any time. No particular feature, file format, metadata field, browser, device, performance level, or period of availability is guaranteed.

2. Permission to use the Service

Subject to these Terms, you are granted a limited, revocable, non-exclusive, non-transferable permission to access and use the official Service for lawful personal or professional end-user purposes. This permission applies only to normal use of the Service and does not grant a license to copy, distribute, publish, host, mirror, clone, frame, repackage, sublicense, sell, or redeploy any protected part of the Service.

You may use metadata exports produced through normal use of the Service, subject to any rights held by you or others in the underlying photographs, files, and metadata. No ownership interest in the Service itself is transferred to you.

3. Intellectual property

Except for user content and identified third-party materials, the Service and its original content, software, design, interface, documentation, graphics, styling, and other protectable elements are owned by Lilo Huang and are protected by applicable intellectual-property laws.

4. Prohibited conduct

You must not:

- use the Service or any output to violate applicable law or the rights of another person;
- access, process, export, publish, or distribute photographs, files, metadata, location information, or other material without the necessary rights or permission;
- copy, extract, modify, distribute, publish, sell, sublicense, host, mirror, clone, frame, white-label, or redeploy protected parts of the Service except as expressly permitted by applicable law;
- remove, conceal, alter, or falsify copyright, attribution, provenance, or rights-management information;
- interfere with, disrupt, overload, damage, bypass, or attempt to gain unauthorized access to the Service or its supporting systems;
- introduce malicious code or use the Service to develop, distribute, or facilitate harmful or unlawful material; or
- use the exif.pl name, branding, visual identity, or domain in a way that falsely suggests authorization, sponsorship, affiliation, or origin.

5. User content and responsibility

You retain any rights you hold in photographs, files, metadata, and exported data that you provide or create through the Service. exif.pl does not claim ownership of that material.

You are solely responsible for your material, your use of the Service, and the legality, accuracy, quality, sensitivity, and consequences of your inputs and outputs. You represent that you have all rights and permissions necessary to access, process, inspect, export, and share the material you use with the Service.

Metadata may contain precise location, device identifiers, timestamps, authorship information, private notes, thumbnails, previews, serial numbers, or other sensitive information. You are solely responsible for reviewing metadata and deciding whether it is appropriate to display, export, retain, or share.

6. Backups and results

Metadata parsing, decoding, grouping, filtering, preview extraction, and export may produce incomplete, inaccurate, unexpected, or unusable results because of browser behavior, device limitations, file characteristics, malformed or unsupported data, software defects, or differences among metadata standards and writing applications.

You are solely responsible for keeping independent backups of all original files. Before relying on, publishing, distributing, or deleting any material, you must inspect and verify all metadata, previews, exported data, file associations, and other results important to you. The Service is not a substitute for professional forensic, evidentiary, archival, security, compliance, or recovery tools.

7. Third-party materials and services

The Service may include third-party software or interact with third-party websites, fonts, browsers, platforms, map providers, file systems, or other services. Third-party materials and services are governed by their own terms, licenses, and privacy practices. Their availability, behavior, security, accuracy, and content are outside the control of Lilo Huang, and their inclusion or use does not constitute an endorsement or warranty.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LILO HUANG DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, CONDITIONS, AND GUARANTEES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, COMPATIBILITY, PERFORMANCE, AND ERROR-FREE OR UNINTERRUPTED OPERATION.

NO INFORMATION, METADATA, PREVIEW, EXPORT, OR OTHER RESULT OBTAINED THROUGH THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LILO HUANG SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS, DELETION, CORRUPTION, DISCLOSURE, MISINTERPRETATION, OR ALTERATION OF PHOTOGRAPHS, FILES, METADATA, OR OTHER DATA; LOSS OF PRIVACY, PROFITS, REVENUE, BUSINESS, OPPORTUNITY, USE, OR GOODWILL; DEVICE OR SOFTWARE DAMAGE; OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SERVICE OR ITS USE, INABILITY TO BE USED, OR RESULTS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

YOU ASSUME ALL RISK ASSOCIATED WITH USING THE SERVICE, INCLUDING THE RISK OF FILE LOSS, DATA LOSS, DISCLOSURE OF SENSITIVE METADATA, INCORRECT OR INCOMPLETE RESULTS, INCOMPATIBILITY, INTERRUPTION, OR DAMAGE.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY WARRANTY, RIGHT, REMEDY, OR LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

10. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Lilo Huang from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Service, your material, your violation of another person's rights, or your material breach of these Terms.

11. Suspension and termination

Your permission to use the Service ends automatically if you materially violate these Terms. Access may also be suspended or terminated when reasonably necessary to protect the Service, its users, intellectual property, or legal rights. Sections that by their nature should survive termination will remain in effect, including sections concerning intellectual property, responsibility, disclaimers, limitation of liability, indemnification, and general provisions.

12. Changes to these Terms

These Terms may be revised from time to time by publishing an updated version on the Service. The revision year may be changed when material updates are made. Continued use of the Service after updated Terms are published constitutes acceptance of the updated Terms to the extent permitted by applicable law.

13. General provisions

These Terms, together with the Copyright and Proprietary Rights Notice and applicable third-party licenses, constitute the entire agreement concerning use of the Service. Third-party license terms control only with respect to the third-party materials they cover.

If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect. Failure to enforce any provision is not a waiver of the right to enforce it later. No waiver is effective unless expressly made in writing by the party granting it.
